We do not believe that puppies or dogs are best served by being kennel raised. By placing them in homes that will be their forever home from the time they are puppies, we are doing our best to ensure their happiness and best start in life. We never have to kennel raise a dog when utilizing guardian homes. The majority of guardian homes are families who cannot afford to purchase a puppy of this quality, and there are others who simply like the idea of how our program works and wants to be a part of it with us. For those who could not afford to purchase a puppy outright, the guardian home option is a fantastic way to have a new puppy/family member. We benefit as a breeder because we do not need to have to utalize kennels. We do not have to care for more dogs than we can manage easily in our own home. We know each dog has a forever home from the time they are young. We provide service dogs for people in need, these are great companion dogs for the elderly, for people that suffer from depression, therapy dogs for the veterans, emotional support needs, autistic and adhd needs and so many more. There are always a lot of questions people have about the guardian program. The collection of questions and answers below are our best attempt to address all questions right up front so someone does not feel like they were not given all of the details about how this program works. Hopefully this information doesn’t overwhelm you. It really is a very simple program even though it may seem like it has a lot of details. The main thing to remember is, we love our dogs and we want to grow our program at the same time but we do not want to become a puppy mill ever! Everyday people buy a puppy believing it is from a great family only to find out that there beloved puppy has come from a puppy mill, people that are advertising puppies on greenfield puppies, petfinder etc. these are all Amish run puppy mills! People choose these sites because you can find a puppy on those sites the cheapest but what you get is a puppy with no genetic testing and vet bills that can cost you thousands. We value our dogs as family members and we hope that you can see how this program benefits families and our four legged friends.

(“Guardians”)

Breeders are in the business of breeding Cavapoo and Moyen Poodles and would like to place a Cavapoo or Moyen Poodle owned by Breeders with Guardians. The Guardians agree to provide physical, loving care and to provide supervision of the dog as stated in this agreement. Both parties (Breeders and Guardians) agree to be legally bound by the following agreement: The dog subject to this agreement is a Cavapoo or a Moyen Poodle named.

Ownership shall remain with the Breeders until the time when the Breeder shall, by written evidence, transfer ownership of the dog to the Guardians. Likewise, any semen from any male dog shall be the sole and separate property of the Breeders and the Guardians shall have no ownership or possession rights to use any of the semen. The purchasers are Guardians to said dog and are authorized to have the dog licensed in there county they as guardians will make decisions for the dog regarding grooming, medical care/treatment and all things regarding the best interest as long as they remain within the guidelines of breeders. Upon completion of this agreement, Breeders shall transfer ownership of the dog to Guardians where they become the owners of the dog. Guardian shall retain possession of the dog and shall provide physical care to and supervision of the dog subject to the dogs conditions of the agreement. Breeders Responsibilities: During the time the Guardians have possession of the dog the Breeders shall provide the Guardians with 1. a list of approved dog food and treats 2. May visit the residence up to 3 times a year at a prearranged time and show up once a year unannounced. 3. Agree upon a personal veterinarian for all medical care 4. Training on recognizing when a female comes into heat or season and approximate dates when to expect this 5. Notice to deliver dog for Semen collection or Breeding 6. Information on what to expect and how to care for a pregnant female 7. Pay for all veterinary cost related to pregnancy, checkups and vaccinations. 8. If the dog is a female, Breeder will take possession of the dog at the appropriate time for breeding and the dog will remain with breeder anywheres from 2-7 days then will be returned to the Guardians for her pregnancy. The Breeder will take possession of the female approximately one week before her due date and she will remain with the breeder until her puppies and whelped and weaned 7-8 weeks. 9. If the dog is male, Breeder will take possession of the dog at the appropriate time and will remain the the Breeder for approximately 2-7 days. Guardians Responsibilities: During the time the Guardians have possession of the dog, the Guardians shall: 1. Safely confine the dog by using a traditional fence, invisible fence, or by restraining the dog with a leash. No dog shall be left outside by his or herself at anytime this is for the safety of the dog. 2. Provide adequate exercise for the dog on a daily basis. 3. Provide basic obedience training for the dog either at home or with a professional sit, stay, walk well on a lease and is crate and potty trained is a must! 4. Buy only the dog food and treats that is approved by the Breeder. 5. Provide vet care as needed, including regular vaccinations and take the dog to the vets if needed especially when she has a scheduled appointment that the Breeder makes. Guardian must make Breeder away what is going on at all times if the dog needs to go to the vets. 6. Consult with Breeder at the first sign of illness or injury this includes diarrhea, loss of appetite, vomiting, etc. 7. Guardian is responsible for bringing the dog to Breeders residence when requested this can also be done by an approved transporter the cost is solely the Guardians expense 8. Notify Breeder of scheduled vacations and if the dog has to be boarded for any reason 9. Maintain a principal place of residence and provide Breeders with guardians address. 10. License dog in your county solely Guardians expense 11. Keep dog well groomed at all times. The dog will need regular brushing and a trip to the groomers every couple of months is a must! 12. If the dog is female the guardian is responsible for bringing the dog for the breedings and whelping
13. Breeder will decide how many litters the dog will have after seeing how she is as a mother and how she tolerates pregnancy, labor, and the weeks following delivery of her puppies. 14. If the dog is female and there is a problem with any pregnancy that permanently endangers the health of that dog, no future breeding will be required, the dog will be spayed as soon and medically appropriate, and ownership is transferred to the Guardian. Removal Of The Dog: Breeders May remove the dog from the Guardians for non-compliance of terms of this agreement, at which time this Agreement shall terminate. Breeders agree to consult with Guardian before permanently removing the dog from Guardians possession unless, in the judgement of the Breeders, the dog must be immediately removed from the Guardians possession, Breeders shall give Guardians a reasonable amount of time to comply with Breeders requirements for maintains the health, welfare or safety of the dog before permanently removing the dog. Removal of Stud Dog: Breeders May remove a stud dog from the Guardians home should the Guardians hire out the stud, or sell his semen, without specific written permission from the Breeders. If this occurs the Guardians will also pay the Breeders $5,000 as a stud fee along with the removal of the stud. Death of Dog Guardians Possession: should the dog die of natural or accidental causes, that are not considered negligence ( non-compliance of using a leash or not keeping the fence in good repair or gate closed) this Agreement shall terminate upon the happening of such occurrence and neither party shall have any further obligation to the other party. Death of Dog Breeders Possession: should the dog die of natural or accidental causes, that are not considered negligence (non-compliance of using a leash or keeping the fence in good repair or keeping the gate closed) this Agreement shall terminate upon the happening of such occurrence and neither party shall have any further obligations to the other party, however should a female die during whelping Breeder shall give to Guardian at no cost to Guardian a puppy born of that litter that caused the death of the female dog. If all puppies die Guardians may wait to take another puppy from another litter no money will be exchanged. Transfer of Ownership: Breeders will transfer ownership to Guardians when the female or male is done being used a female 4 litters or sooner depending on her health and a male 5 years depending on his health. The female or male dog will be spayed or neutered at no cost to the Guardian. Return of the Dog: During the term of this agreement, the Guardian may permanently return the dog to the breeders with all vet records and this contract shall terminate. No refunds will be given. If the dog is returned in such a condition that it no longer can be ethically bred, Guardians will be responsible for financial compensation to Jeremy and Andrea Steria in the amount of $10,000 Immediate Payment To Breeders: if, prior to ownership from Breeders, to Guardians, the following occurrences happen, the Guardians agree to pay the Breeders the sum of $40,000 1. Guardian, independently and without the expressed written consent of Breeders, has the dog spayed or neutered. 2. Guardian intentionally causes injury to the dog that prevents the dog from breeding or intentionally or out of negligence causes the death of the dog. 3. Guardian absconds with the dog, fails to advise Breeders of any change or address, or ceases communication with Breeders. 4. Guardians refuse to deliver or work with transportation to Guardians residence at Breeders request for breeding or whelping.
Non-transferable: This Agreement shall not be transferred to another Breeder or Guardian in whole or part without prior agreement.
Notifications and Correspondence: notifications and communication as required by the terms of this agreement shall be made, if made, via email or phone.
THIS CONTRACT IS NON-TRANSFERABLE TO OTHER PARTIES, NOR OTHER PUPPIES/DOGS. IN THE EVENT THAT THE BUYER BREAKS ANY PART OF THIS CONTRACT, THE BUYER MUST PAY ALL FEES ASSOCIATED ENFORCING THIS CONTRACT OR REPOSSESSING THE PUPPY/DOG. THERE ARE NO OTHER IMPLIED, WRITTEN, OR VERBAL AGREEMENTS OTHER THAN THOSE OUTLINED IN THIS CONTRACT. SHOULD ANY DISPUTE REGARDING THIS CONTRACT ARISE, THR LAWS OF THE STATE OF NEW YORK SHALL BE CONTROLLING AND ANY LEGAL PROCEEDINGS MUST TAKE PLACE AT BUYERS EXPENSE.
